As in the case of service abroad, as regards serving foreign proceedings on a party within the Polish jurisdiction, the rules of the country where the defendant is domiciled apply.
Where the claim was issued in an EU Member State Regulation (EC) No 1393/2007 of the European Parliament and of the Council of 13 November 2007 on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters applies. Service pursuant to this Regulation should be effected through the Polish regional courts.
Where the Regulation does not apply, and the claim originates from a country which is a party to the Hague Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters the request for service should be made to the Polish Ministry of Justice.
